Terms of service

These terms are an agreement between you and Circus Corporation, a Delaware corporation ("we", "us"), and apply when you use hurdle.so and the Hurdle app at app.hurdle.so (together, "Hurdle"). By creating an account or using Hurdle, you agree to them. If you use Hurdle for a company, you agree on its behalf.

Your account

You need an account to use the app. Keep your sign-in details private; you're responsible for what happens under your account. You must be at least 18, or the age of majority where you live.

Plans and billing

Paid plans are billed in US dollars and renew automatically each month or year until you cancel. By subscribing, you agree to that recurring charge on the payment method you provide. You can cancel any time online in your account's billing settings — canceling is as easy as signing up — and your plan stays active until the end of the period you've paid for. We'll email you a receipt for each charge. Prices may change; we'll give you at least 30 days' notice by email before a new price applies to your plan. You're responsible for any taxes that apply.

Refunds

If Hurdle isn't right for you, email support@hurdle.so within 90 days of your first payment on an account and we'll refund that payment in full. This guarantee applies once per customer. We may decline a refund, or ask you to talk with us first, where we reasonably believe it's being abused — for example, repeated sign-ups to reclaim the same guarantee.

Your designs

As between you and us, you own the prompts you write and the models and files you create with Hurdle, and we assign to you any rights we hold in that output. Because it's generated with AI, output may not always be unique to you, and we can't guarantee it's free of third-party rights. You give us permission to store, process and send your prompts and designs to our service providers (including the AI model providers listed in our privacy policy) only so we can run the service, keep backups, and investigate abuse. You also grant us a limited license to use de-identified, aggregated usage data to improve Hurdle. If you send us feedback about Hurdle, we can use it without owing you anything for it.

Check before you make

Hurdle's output is generated by AI and checked against the constraints you gave it — that doesn't mean it's correct, safe, or fit for any particular purpose. Dimensions, tolerances, fits, materials and structural assumptions can all be wrong. Hurdle is a design tool, not a certification, and it isn't a substitute for a qualified engineer. Before you manufacture, sell or rely on a part — and always before using a part in a safety-critical, structural, load-bearing, pressure-bearing, medical or regulated application — have it independently reviewed by someone qualified. You're responsible for how you use what you design.

Acceptable use

Don't use Hurdle to: break the law or infringe anyone's rights; design, or attempt to design, firearms, firearm frames or receivers, ammunition, suppressors, explosive devices, or other weapons or items intended to cause harm; attack, overload or reverse-engineer the service; or try to access other people's accounts or data. You'll also follow any usage policies our AI model providers publish for their models, which we'll link to on request. We may suspend or terminate accounts that break these rules, with or without notice.

You won't use Hurdle to process technical data controlled under the US International Traffic in Arms Regulations (ITAR) or Export Administration Regulations (EAR) unless you're separately authorized to do so, and you won't access or use Hurdle from a country, or as a person or entity, subject to US trade sanctions or export restrictions.

Our service

We work hard to keep Hurdle available and accurate, but it's provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We can't promise Hurdle will be uninterrupted, error-free or that its output will meet your requirements. We may change, suspend or discontinue features over time. Some features may be offered as beta or early access and may change or be removed without notice. Hurdle links to and embeds some third-party services (like YouTube); we aren't responsible for those services' content or availability.

Liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential losses, or lost profits or data. Each party's total liability to the other arising out of these terms is limited to the greater of (a) $100, or (b) the amount you paid us in the 12 months before the claim. This limit doesn't apply to your payment obligations, to either party's indemnification obligations, or to liability that can't be limited by law, including death or personal injury caused by negligence, or fraud. Nothing in these terms limits rights you have under consumer laws that can't be waived, including in the EU, UK and Australia.

Copyright complaints

If you believe content on Hurdle infringes your copyright, email support@hurdle.so with the information required under the US Digital Millennium Copyright Act: a description of the work, the material you believe infringes it, your contact details, and a statement made under penalty of perjury that you're authorized to act and that the use isn't authorized.

Ending your account

You can close your account at any time. We may suspend or close accounts that break these terms. When an account closes, you can ask us for an export of your work first; we keep it for up to 30 days after closure before deleting it, as described in our privacy policy.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless the law where you live gives you the right to bring a claim locally.

General

If any part of these terms turns out to be unenforceable, the rest still applies. These terms, along with our privacy policy, are the entire agreement between us about Hurdle. You can't transfer your account or these terms to someone else without our consent; we can transfer them as part of a merger, acquisition or sale of assets. We're not liable for delay caused by anything reasonably outside our control. By using Hurdle, you agree we can send you notices and disclosures electronically, including by email.

Changes to these terms

If we make a significant change, we'll update the date above and email account holders at least 30 days before it takes effect.
